Copyright. The copyright and other intellectual property rights in all content included on this site is either owned by us or licensed to us. You may use the material on this web site for your own private study, non-commercial research, and non-commercial instructional or educational purposes (including use on an educational intranet restricted to authenticated users). GUIDELINES FOR SUBMITTING MATERIAL TO "Geography in the News".


Content

The Royal Geographical Society ("the Society") has the right to select and edit any material submitted for space reasons but we will try not alter the sense of the material submitted. We also reserve the right to delete material from the Geography in the News website at our sole discretion.

You can only submit material where you own the copyright. You must not infringe the rights of third parties, including copyright, rights in trademarks or rights in confidential information, and you will be responsible if you do use someone else's material without their permission.

You must not submit any material that is unlawful, defamatory, abusive, obscene, sexually oriented, racially offensive, or otherwise objectionable.

Publication

The Society has the right to reject work on the grounds of infringement of any of the above rules. The Society is not obliged to publish the work submitted, and may edit the work. It is anticipated that most contributions will stay on the site for a minimum of two months, but the Society reserves the right to remove any material at any time, without notice.

Privacy

By submitting material, you give us permission to publish your name whenever the story is published. If you do not wish to be named, please email us on gin@rgs.org.

The Society will need your name and contact details to add to our list of copyright owners. Please let us know if you change your contact details so that we can keep this list up to date. We will not pass these details to third parties. We will not publish your contact details (other than your name) on the website.

The material you submit will be kept in our archives as a record of the project. If at any point you would like your story to be removed from the Geography in the News site and the Society archives, please email us on gin@rgs.org.

Rights

The copyright of the work you submit will remain with you. However by submitting material you agree to us publishing it on our website and permitting its use according to our website terms of use, and using it in our publicity material. If the Society wishes to publish your material elsewhere, it will seek your permission beforehand.

PRIVACY POLICY

This policy sets out how we use any personal information you submit to us. We are committed to safeguarding the privacy of personal information.

This privacy policy applies to all "personal data" as defined in the Data Protection Act 1998. In this privacy policy, we also refer to personal data as "data", "information" or "personal information".

INFORMATION COLLECTED

We collect personal information from you in order that our services can be offered as effectively as is possible. The only personal information we routinely collect is the information requested on forms contained on our website.

Like most websites, we routinely monitor IP addresses of the computer from which users access the site. We use such data only to monitor levels of traffic to the site, and we do not match this data with individual user records.

If you contact us for any reason, we may retain copies of any letters or emails, and may record written details of any telephone conversation with you. We will not make any audio recording of telephone conversations.

USE OF INFORMATION

We use information held about you only for the following purposes:

  1. providing the services offered through our website;
  2. informing you of changes to this privacy policy;
  3. contacting you for reasons set out in our terms of use;
  4. responding to queries from you.

MARKETING

We will not use information collected on this website for marketing purposes and we will not pass your details onto anyone else for marketing purposes.

We may use information collected on this website to send you information about the Royal Geographical Society (with Institute of British Geographers) if you give us consent to do so.

We may use information held about you for the purposes of analysing how our services are used and how we may improve our services in future. Any information we use will be converted into a form in which we cannot identify you, and will be kept strictly confidential.

If at any stage you would like to check the information held by us about you please either:

  1. send an electronic mail to privacy@rgs.org; or

We will take the necessary action within a reasonable time. We reserve the right to charge a fee of 10 for complying with such a request. We also reserve the right to take reasonable steps to confirm your identity before making any disclosure of information held by us.

CHANGE TO PRIVACY POLICY

If we change this Privacy Policy, the amended Privacy Policy will be posted on this website and the revised Policy will take effect once posted. Your continued use of this website after the posting will signify your agreement to the new terms.

TRANSMISSION OF DATA

Whilst we have taken all reasonable steps to ensure that the information you provide will be kept secure from unauthorised access we cannot guarantee that the information will be secure during transmission by you to this website.

TERMS AND CONDITIONS OF USE FOR SUBSCRIBERS

Single User licences: Unless otherwise stated, the licence is a single user licence. Where the licence is a single user licence, each user licence entitles you either to access the service on a single computer; or for use by only one computer at any given time.

School Licences: Where the licence is stated to be a licence given to a school or other institution, then you are licenced to access on any computers at the school or other institution, or simultaneous access by all computers at the school or other institution. You are also allowed to give the username and password to students and pupils for use at home (usual place of residence) as long as they are not encouraged to disclose the username or password to anyone user outside of that school or institution.

Schools agreement

Please read this Agreement carefully as it governs your use of this site's subscription service ("the Service"). By accessing the Service you are agreeing on behalf of your school to the terms that appear below. You are agreeing that you represent a school, college of institution teaching students up to the age of 19 or level 3 of the National Qualifications Framework. If you have any questions please email us at gin@rgs.org. If you do not agree with these terms or are not authorised to agree them please do not click "I have read and fully understand and accept the terms and conditions - your order will then be cancelled and no charge will be made.

References in the remainder of this Agreement to "you" and "your" are references to your school (School is defined as school or college teaching students up to the age of 19 or level 3 of the National Qualifications Framework).

1 Provision of Service

1.1 The Geography in the News website ("the Site") and the Service is operated by the Royal Geographical Society (with the Institute of British Geographers) of 1 Kensington Gore, London, SW7 2AR, United Kingdom ('we', 'us', 'our'). For our other contact details, please see our contacts page at www.rgs.org. We agree to provide you with reasonable support by telephone or email or during normal working hours for the purpose of assisting you to maintain your access to the Site and the Service.

1.2 You acknowledge that you have provided us with accurate and complete registration information and that it is your responsibility to update us of any changes to that information (including your email address) by emailing gin@rgs.org.

1.3 Each registration is for a single school only. On registration, you will be allocated a user name and password ("ID"). You may choose to authorise your pupils and teachers, (together "Users") to use your ID while on your premises in their home (usual place of residence). You are responsible for all use of the Service by all such Users and anyone else using your ID and for preventing unauthorised use of your ID. You must ensure that your Users comply with the terms of this Agreement and all reasonable user terms made available on the Site.

1.4 If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately by emailing gin@rgs.org.

1.5 If we reasonably believe that your ID is being used in any way which is not permitted by this Agreement, we reserve the right to cancel access rights immediately on giving notice to you and to block access from your ID.

2 Limited Rights to Use Content

2.1 All material displayed on the Site ("Content") belongs to us or our licensors. Subject to clause 2.2, your Users may retrieve and display the Content on a computer screen, print individual pages on paper and store such pages in electronic form on disk and on your internal server (but not on any other server or other storage device connected to an external network unless we have agreed with your LEA to do this) for your internal educational non-commercial purposes.

2.2 Most of the Content on the Site is owned by us but certain content is used under licence from third parties ("Third Party Content") and will be marked with the copyright notice of those third parties. Some of the Third Party Content will be subject to additional restrictions - the relevant copyright notice will make it clear where that is the case. You are responsible for ensuring that your Users comply with such restrictions.

2.3 You may not (without prior written permission from us):

2.3.1 redistribute any of the Content (including by using it as part of any library, archive or similar service);

2.3.2 remove the copyright or trade mark notice from any copies of Content made under this Agreement;

2.3.3 create a database in electronic or structured manual form by systematically downloading and storing all or any of the Content;

2.3.4 except as expressly set out above, modify, reproduce or in any way commercially exploit any of the Content.

2.4 You acknowledge that "Royal Geographical Society (with IBG)", "Geography in the News" are trade marks and that you may not use them without written permission.

3 Participation

3.1 The Service may include bulletin boards, discussion groups and other public areas that allow feedback to us and interaction between users. The opinions, advice and statements contained in messages posted on the Site ("Messages") are those of the Users and not us. Copyright in any software that is made available for download for the participation in the Service ("Software") belongs to us or its suppliers. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. Certain promotions on the Site may also be subject to particular terms which will be made available by hyperlink. You will be responsible for ensuring that Users comply with all such terms referred to in this clause 3.1.

4 Warranties

4.1 We will use our reasonable skill in making the Service available to you and in ensuring its continuing availability during your Subscription. However, because of the number of sources from which we obtain the Content and because of the nature of the Internet and computer software and hardware, errors and omissions do occur and we do not give any other warranties in respect of the Service. In particular, you should not take the accuracy of the information for granted and we make no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties. All implied warranties are excluded from this Agreement to the extent that they may be excluded as a matter of law.

5 Limitation of Liability

5.1 We will use its reasonable endeavours to resolve faults in the Service during the Subscription. You agree that your only recovery for damages that you incur, and your exclusive remedy, shall be limited to the direct damages you actually incur up to an amount equivalent to the Subscription Fee actually paid or payable in relation to your use for the relevant year of the service.

5.2 We will not be liable for any consequential or incidental damages (including without limitation, damages for loss of use or profits) arising in contract, tort or otherwise from your (or your Users') use or inability to use the Service or from any action taken (or refrained from being taken) as a result of using the Service.

5.3 Notwithstanding the above provisions of this clause 5, our liability will not be limited in the case of death or personal injury directly caused by our negligence.

6 Changes

6.1 We will continually seek to improve the Service. We reserve the right, at our discretion, to make changes to any part of the Service provided that it does not materially reduce the content or functionality of the relevant service.

7 Links

7.1 The Service contains links to other websites and resources, either directly or through frames and, where possible, we will make clear where such links are being made. Independent third parties provide these sites and we are not responsible and shall not be liable for the availability or content of these outside resources.

8 General

8.1 We may terminate this Agreement if you are in default and in such case we are not obliged to refund you any fees. If we terminate this Agreement because it discontinues the Service, you are entitled to a refund of that part of any fee which relates to the unexpired period of this Agreement.

8.2 You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Service.

8.3 If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

8.4 Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.

8.5 A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.

8.6 This Agreement shall be governed by, and construed in accordance with, English law. The parties irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with this Agreement or the legal relationship established by it, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.

8.7 Headings in this Agreement are for convenience only and will have no legal meaning or effect.

SUBSCRIPTION

Your Subscription begins on the day that you receive email or fax notification from us. It is your own responsibility to ensure that the details are passed on to the relevant person at your school to facilitate access to the site. The fee for your Subscription ("Subscription Fee") is calculated and payable annually on the anniversary of the start of your Subscription (unless otherwise stated) in advance by such method of payment as we request. We shall be under no obligation to provide the Service until the Subscription Fee has been paid.

We will send you details of your Subscription Fee payable for the subsequent year at least four weeks before the anniversary of your current Subscription. Your Subscription will renew only if you make payment of the Subscription Fee before the anniversary of your current Subscription. If you fail to pay the Subscription Fee for any subsequent year before the anniversary of your then current Subscription, we may suspend your access to the Service until your Subscription Fee is paid.
